In an effort to crack down on mortgage fraud, Congress passed the Safe and Fair Enforcement for Mortgage Licensing Act (the “SAFE Act”). Under the SAFE Act, individual states (and the federal government) are required to establish uniform regulations and minimum licensing requirements for mortgage loan originators. “Mortgage Loan Originators” in some instances include sellers financing the sale of their own property. President Obama has signed the Dodd-Frank Wall Street Reform and Consumer
Protection Act (H.R. 4173) into law. Included in this legislation is a
provision which would sunset the much maligned Home Valuation Code of
Conduct (HVCC). The HVCC was put into place as an agreement between New York
State Attorney General Andrew M. Cuomo, Fannie Mae and Freddie Mac with the
intent to change appraiser selection criteria to help eliminate conflicts of
interest on mortgage appraisals. As a result of this agreement, Appraisal
Management Companies (AMCs) have an increased role in the appraisal process.
